General Terms and Conditions
These General Terms and Conditions govern the business relationship between SentByHeaven and our customers. Please read them carefully before placing your order.
Section 1 Scope
(1) These General Terms and Conditions (hereinafter referred to as "GTC") apply to all contracts between SentByHeaven, Paul Welther, Siebenbürgenstr. 20, 74321 Bietigheim-Bissingen and the customer via the online shop at sentbyheaven.de.
(2) A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity (§ 13 BGB).
(3) Deviating, conflicting or supplementary conditions of the customer do not become part of the contract, unless their validity is expressly agreed to in writing.
Section 2 Conclusion of Contract
(1) The presentation of products in the online shop does not constitute a legally binding offer, but an unbinding invitation to order (invitatio ad offerendum).
(2) By clicking the button "Buy now" / "Buy", the customer submits a binding offer to conclude a purchase contract.
(3) The provider can accept the offer within 5 working days by sending an order confirmation via e-mail or by shipping the goods. The receipt by the customer is decisive. The automatic order confirmation does not yet constitute acceptance.
Section 3 Prices and Shipping Costs
(1) All prices are final prices including the statutory value-added tax (§ 1 PAngV).
(2) In addition to the stated prices, shipping costs may apply. These are shown separately during the ordering process and under "Shipping Conditions".
Section 4 Terms of Payment
(1) Accepted payment methods are: credit card (Visa, Mastercard), PayPal, Klarna, Apple Pay, Google Pay, and instant bank transfer. Available payment methods will be shown during the order process.
(2) Payment is due upon completion of the order. Granted discounts or rebates are excluded, unless expressly agreed otherwise.
Section 5 Delivery and Shipping
(1) Delivery times within Germany are generally 1–3 business days from dispatch, and 3–7 business days within the EU. More detailed information can be found in the shipping conditions.
(2) Should an ordered product be unavailable due to unforeseen circumstances, the Provider shall inform the Customer without delay. In this case, any payments already made shall be refunded immediately.
Section 6 Retention of Title
Until full payment of the purchase price, the delivered goods remain the property of the supplier (§ 449 BGB).
Section 7 Right of Withdrawal for Consumers
(1) Consumers have a 14-day right of withdrawal from receipt of the goods (§ 312g in conjunction with § 355 BGB).
(2) The detailed cancellation policy and the sample cancellation form are provided to the customer during the ordering process and in the order confirmation.
(3) The right of withdrawal expires prematurely for contracts concerning the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
Section 8 Warranty
(1) The statutory warranty rights (§§ 437 ff. BGB) apply.
(2) Claims for defects do not exist in the case of only insignificant deviation from the agreed quality or only insignificant impairment of usability.
Section 9 Liability
(1) The provider shall be liable without limitation for damages resulting from injury to life, body or health based on an intentional or negligent breach of duty, as well as for other damages based on an intentional or grossly negligent breach of duty.
(2) In the event of a slightly negligent breach of essential contractual obligations (cardinal obligations), the liability shall be limited to the foreseeable, typical damage for the contract.

Section 11 Dispute Resolution
(1) The European Commission provides a platform for online dispute resolution (ODR): ec.europa.eu/consumers/odr.
(2) We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
Section 12 Final provisions
(1) The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. In the case of consumers, this choice of law shall only apply insofar as the granted protection is not withdrawn by mandatory provisions of the law of the state in which the consumer has his habitual residence.
